Cancellation Policy:

We understand that unforeseen circumstances may arise, and we strive to accommodate our clients to the best of our ability. Please review our cancellation policy below.

Cancellation Fee Structure:

• Late Cancellation (Less Than 48 Hours Notice): A cancellation made with less than 48 hours' notice will incur a cancellation fee of $75.

• No-Show: If a client fails to show up for a scheduled session without prior notice, a no-show fee of $75 will be applied.

Rescheduling:

• Clients are encouraged to provide as much notice as possible when rescheduling a session. No cancellation fee will be applied if the session is rescheduled at least 48 hours before the original appointment.

Exceptions and Considerations:

• Emergency Situations: We understand that emergencies happen. In case of a genuine emergency, please contact us as soon as possible to discuss your situation.

Refund Policy: Cancellation fees are non-refundable. However, we may consider the application of the fee towards a future session under certain circumstances.

Payment Terms:

• Down Payment: A non-refundable down payment of $75 is required upon scheduling to secure your session. This payment is essential to reserve the agreed-upon date and time.

• Full Payment: The remaining balance of the full session fee is due at the beginning of the session.

Payment Methods: Payments can be made through Zelle, cash, Cash App, Venmo, or checks. Details for Zelle payments will be provided upon request.

Liability Coverage:

• Photographer Liability: Mena Saad and DAAS PRO MEDIA shall not be held liable for any injury, loss, or damage to persons or property during the photography session. Mena Saad and DAAS PRO MEDIA are not responsible for clients' subjective dissatisfaction with the final images. Photography is an art, and the interpretation of aesthetics may vary. We make every effort to meet the client's expectations but cannot guarantee individual preferences.

 

Client Liability:

• The client is responsible for the behavior of all persons present at the session. In the event of client dissatisfaction with the final images, legal action shall not be taken against Mena Saad or DAAS PRO MEDIA. Efforts will be made to address concerns and find an amicable resolution, such as additional editing or a reshoot if deemed necessary.

Weather Contingency:

• Weather Contingency: In the event of inclement weather, the session may be rescheduled at no additional cost. Mena Saad and DAAS PRO MEDIA will monitor weather conditions and, if necessary, will discuss rescheduling options with the client at the earliest convenience.

Client Cooperation:

• Client Cooperation: The success of the photography session depends on effective communication and collaboration between the photographer and the client. The client agrees to cooperate and follow the photographer's instructions during the session. This includes posing, positioning, and any guidance provided to capture the desired images effectively.

Ownership of Images (Copyright):

• Ownership of Images: Mena Saad retains the copyright and all other rights to the images captured during the session. The client is granted a non-exclusive license to use the images for personal purposes, including printing, sharing on social media, and other personal uses. Commercial use of the images without the photographer's written consent is prohibited.

Print Disclaimer:

• Prints Not Included: Please note that our services do not include the provision of prints. The client is not to expect prints as part of the package. Digital images will be provided as specified in the selected package.

Usage Rights:

• Photographer's Right to Use Images: The photographer, Mena Saad, retains the right to use the images for self-promotion, marketing, and advertising purposes both online and offline.

Delivery Timeframe:

• The final edited images will be delivered to the client within 14 business days from the date of the photography session. Mena Saad and DAAS PRO MEDIA will make reasonable efforts to provide the images promptly within this timeframe. If unforeseen circumstances arise that may cause a delay, the client will be notified promptly.

Force Majeure Clause:

• Force Majeure: Neither party shall be held responsible for any failure or delay in performance of any part of this agreement to the extent such failure is caused by fire, flood, explosion, war, strike, embargo, governmental action, act of God, or any other cause beyond the control of either party ("Force Majeure Event"). If a Force Majeure Event occurs, the affected party shall promptly notify the other party, and the parties shall make reasonable efforts to resume performance as soon as possible. If performance is delayed for more than [specify number] days due to a Force Majeure Event, either party may terminate this agreement without penalty.

Indemnification Clause:

• Indemnification: The Client agrees to indemnify and hold harmless Mena Saad and DAAS PRO MEDIA from any and all claims, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to the Client's use of the images, any breach of this agreement, or the actions or omissions of any individuals present at the photography session. Mena Saad agrees to indemnify and hold harmless the Client from any claims arising out of the professional services provided under this agreement. However, Mena Saad's liability for any claim shall not exceed the total fees paid by the Client under this agreement.

Governing Law:

• This agreement shall be governed by and construed in accordance with the laws of the State of Louisiana.
